Article 1. Definitions

1. Buyer: The person who undertakes to purchase what has been agreed;
2. Seller: The person who undertakes to deliver what has been agreed;
3. Batch (in the sense of delivered flower bulbs): the entire number in one delivery

Delivered Flower Bulbs of each variety separately, unless they have been purchased mixed or, pursuant to the purchase agreement, have been delivered sorted according to size, in which latter case each size is regarded as a batch;

4. Product(s): flower bulbs, tubers, rhizomes, perennials and related and supplied items, including non-returnable packaging material, all in the broadest sense of the word;
5. Size (also sifting size): for flower bulbs, unless otherwise agreed, the size is determined by the size of the bulb measured on the measuring board, or as is customary in practice;
6. Working day: days not being a Saturday, Sunday or public holiday recognized by law;
7. Agreement: The written agreements between the Buyer and the Seller regarding the delivery of products.

 Article 2. Applicability

1. These terms and conditions apply to all agreements between Buyer and Seller regarding the delivery of Products. Conditions of the Seller are expressly rejected.
2. Deviations from these terms and conditions are only valid insofar as expressly accepted in writing by the Buyer and deviations only apply to the agreement to which they relate.
3. If any provision of these purchase conditions is void or destroyed, the other provisions will remain in full force and effect.

Article 3. Conclusion of agreement

3.1 An agreement is concluded by the online offer of the Seller and acceptance of this offer by the Buyer after the complete completion of the online ordering process, including full payment by the Buyer.

3.2 When placing an order, it is assumed that the Buyer fully agrees with the General Terms and Conditions.

Article 4. Prices

4.1 All prices in the webshop are in Euros exclusive of VAT.

The prices of the products are stated as follows;

1. per piece and
2. converted to sales unit per box.

Prices of flower bulbs are exclusive of 9% VAT.

4.2. Packaging is charged on and cannot be exchanged and/or cannot be returned.

Packaging is taken over by Buyer for €2.40 per export box;

any coasters for € 2.50

any pallets €9.50 each

Packaging prices are excl. 21% VAT.

4.3 Administration and handling costs of €7.50, excluding 21% VAT, will be charged per order.

4.4 Shipping costs will be charged per order. The shipping costs are calculated on the basis of the number, size, weight and destination of the products that are ordered. The shipping costs are definitively calculated during the ordering process.

Article 5. Deliveries

5.1 Delivery takes place by delivery of the Products by the Seller to the Buyer on the date, place and/or time as agreed. Agreements relating to multiple partial deliveries are regarded as equally many obligations to deliver on specific dates and/or times.

5.2. Delivery takes place at the expense and risk of the Seller. If it has been agreed that the Buyer arranges transport, the delivery will be at the expense and risk of the Buyer.

5.3. In the event of delivery on demand, the Seller is obliged to deliver the products within the agreed term after the Buyer has called in, where the Buyer is obliged to purchase them within that term.

5.4 However, should it happen that a product is temporarily out of stock, the Buyer will be informed immediately and you will be offered an alternative product.

5-1 All orders are prepared within 1 business day and shipped the next business day.

5-4 The Seller is not liable for exceeding the indicated delivery times.

5-5 If the Buyer has received an incorrect (partial) order, the Seller will ensure that the correct items are sent. The shipping costs are for the account and risk of the Seller.

Article 6. Information

6.1. Upon delivery, the Seller will make available to the Buyer information including (1) the Seller's details, (2) the specifications of the Products, (3) information regarding any agreed Classification and (4) other information relevant to the merchantability of the Products, including

required quality certificates and Plant Passport.

Article 7. Quality

7.1. The Seller guarantees that the quality of the Products at the time of delivery to the Buyer is in accordance with what the Buyer may expect, as well as in accordance with the applicable guidelines and regulations of competent government authorities, inspection authorities and other relevant authorities that apply generally applicable or generally accepted guidelines with regard to the Parties. and issue regulations regarding phytosanitary matters, quality, quality classification, tolerances with regard to color, dimensions, etc., including but not limited to the inspection services (BKD, Naktuinbouw).

7.2 Any complaints can be submitted to the Seller in writing or by email.

7.3. bulb size; Seller delivers the size determined during processing. Natural storage shrinkage is at the expense and risk of the Buyer.

7.4. Buyer accepts 3% loss per variety due to diseases and/or bulbs without stems. If the dropout is more than 3%, a credit is discussed after deduction of this 3%. Claims for Amaryllis bulbs must be submitted before December 15, 2021, claims will not be accepted after this date.

Article 8. Liability

8.1 The content of this site has been compiled with the greatest care. However, the seller cannot exclude that certain information is incorrect and/or incomplete. The seller is not liable for the consequences of incorrect or incomplete information on its website.

8.2 The seller is not responsible for typing, typing and printing errors that could inadvertently communicate an incorrect sales price. If this occurs, the price will be adjusted by the Seller as soon as possible.

8.3 The seller cannot be held responsible for color deviations as a result of screen quality.

Article 9. Force majeure

9.1 Without prejudice to its other rights, in the event of force majeure, the Seller has the right, at its discretion, to suspend the execution of your order or to dissolve the agreement, without judicial intervention, by notifying you in writing. parts and without the Seller being obliged to pay any compensation, unless this would be unacceptable in the given circumstances according to standards and reasonableness and fairness.

Article 10. Privacy statement

10.1 All personal data will be used exclusively by the Seller and will never be made available to third parties.

Article 11. Returns

11.1 The Seller will not accept returned products without the Seller's prior written consent.

Article 12. Disputes

12.1 Any complaints, regarding defects and shortcomings, must be reported in writing within five (5) days of receipt of the order.

Complaints about alleged inauthenticity observed during the start of flowering must be reported in writing without delay. A fee will never exceed the invoice value. We cannot guarantee regrowth.

 Article 14. Governing Law

14.1 All rights, obligations, offers, orders and agreements to which these General Terms and Conditions apply, as well as these terms and conditions, are exclusively governed by Dutch law.
